City Files Legal Action Against CSX

Subject: Planned Closure of US 136/Market Street - Legal Action

The City of Crawfordsville was notified last week that CSX Transportation intends to close the rail crossing in the 400 blk. of East Market Street for maintenance work within the next week.  This section of roadway also carries US 136, SR 32 & SR 47 and more than 13,000 vehicles daily.

Any time this crossing is closed, or obstructed, there is a significant impact to traffic flow and public safety.  Of course, traffic is normally rerouted to Wabash Avenue, where there is a bridge over the railway.  Unfortunately, Wabash Avenue is currently closed for a total rebuild and is not expected to be reopened until mid-August. 

The closure of Market Street would eliminate all east-west thoroughfares except Main Street, which is in a residential area and has limited capacity, and Elmore Street which is much further south and plagued by frequently stopped trains on the crossing. 

We are very concerned about the impact to traffic flow and public safety this closure would create and have been in constant communication with representatives of CSX Transportation since learning of their intended closure.  We have repeatedly requested they defer their maintenance project until August 15 to allow for the completion and reopening of Wabash Avenue.  To date, we have been unsuccessful in our discussions and CSX has not been willing to alter their plans to accommodate our public safety concerns. 

As a result, the City of Crawfordsville is filing legal action against CSX Transportation and Indiana Department of Transportation (INDOT) seeking an emergency order to prevent the closure until August 15 and the reopening of Wabash Avenue. 

We regret that legal action is necessary but we have exhausted all other means and must take every step possible to ensure public safety. 

We will provide updates as the courts consider our request.
